O acordo havia sido homologado apenas parcialmente pelas inst\u00e2ncias inferiores, o que, segundo o colegiado, \u00e9 vedado em processo em que as partes acionam voluntariamente a Justi\u00e7a.<br><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Gestante&nbsp;<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>A supervisora foi demitida sem justa causa em agosto de 2020, mas, logo ap\u00f3s a rescis\u00e3o, informou ao Mercado Livre que estava gr\u00e1vida. Diante da situa\u00e7\u00e3o, ela poderia pleitear a reintegra\u00e7\u00e3o em reclama\u00e7\u00e3o trabalhista, mas preferiu firmar acordo pelo qual a empresa pagaria R$ 247 mil de indeniza\u00e7\u00e3o estabilit\u00e1ria. Caso homologado judicialmente, o acordo quitaria o contrato de forma irrestrita, e ela n\u00e3o poderia mais ajuizar a\u00e7\u00e3o contra a empresa.<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Reforma trabalhista<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>A possibilidade de negocia\u00e7\u00e3o pr\u00e9via foi uma das novidades trazidas pela Reforma Trabalhista (Lei 13.467\/2017, artigo 855-B e seguintes da CLT), em que as partes podem, de forma conjunta, pactuar livremente os termos do acordo e peticionar sua homologa\u00e7\u00e3o pelo juiz do trabalho, sem a necessidade de ajuizamento de reclama\u00e7\u00e3o trabalhista, e, assim, extinguir o contrato de trabalho.&nbsp;<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>O artigo exige que as partes n\u00e3o sejam representadas pelo mesmo advogado e n\u00e3o obriga que o trabalhador esteja acompanhado pelo advogado do sindicato da categoria. Nesse caso, o juiz ter\u00e1 15 dias para analisar o acordo, designar ou n\u00e3o a audi\u00eancia e, em seguida, proferir a senten\u00e7a homologat\u00f3ria. Vale lembrar que o juiz n\u00e3o est\u00e1 obrigado a homologar o acordo caso julgue haver alguma ilegalidade ou v\u00edcio no acordo que prejudique o empregado.&nbsp;&nbsp;<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Pedido rejeitado<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Todavia, ao analisar o acordo, o ju\u00edzo do Centro Judici\u00e1rio de Solu\u00e7\u00e3o de Conflitos e Cidadania (Cejusc) de Barueri (SP) entendeu que os termos e as condi\u00e7\u00f5es estabelecidas pelas partes inviabilizavam a quita\u00e7\u00e3o integral da transa\u00e7\u00e3o e a homologou parcialmente, apenas em rela\u00e7\u00e3o apenas aos direitos listados ((indeniza\u00e7\u00e3o pelo per\u00edodo de estabilidade gestante).&nbsp;<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>A senten\u00e7a foi mantida pelo Tribunal Regional do Trabalho da 2\u00aa Regi\u00e3o (SP). Segundo o TRT, o artigo 843 do C\u00f3digo Civil disp\u00f5e que a transa\u00e7\u00e3o deve ser interpretada restritivamente, n\u00e3o sendo poss\u00edvel a quita\u00e7\u00e3o gen\u00e9rica de parcelas que n\u00e3o constam na peti\u00e7\u00e3o de acordo.<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Formalidade legal<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>No recurso de revista, o Mercado Livre sustentou que a decis\u00e3o havia prejudicado ambas as partes. A empresa lembrou que todas as verbas foram pagas dentro do prazo legal e que as partes se compuseram amigavelmente, firmaram o acordo e buscaram o Judici\u00e1rio apenas para sua homologa\u00e7\u00e3o, de maneira a cumprir a formalidade legal e atribuir seguran\u00e7a jur\u00eddica ao ato.&nbsp;<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Ainda, segundo a empresa, a decis\u00e3o \u201cacabou por prejudicar a trabalhadora, que n\u00e3o pode receber a indeniza\u00e7\u00e3o a qual tem direito em raz\u00e3o do seu estado grav\u00eddico\u201d. Tamb\u00e9m argumentou que a supervisora havia concordado expressamente com todos os termos e tinha a completa ci\u00eancia de que, uma vez aceitos, n\u00e3o mais poderia reclamar sobre o seu contrato de trabalho, reconhecendo a quita\u00e7\u00e3o ampla e geral.<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>Validade<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>A relatora, ministra Dela\u00edde Miranda Arantes, afirmou que a quita\u00e7\u00e3o do acordo deve ser reconhecida nos termos em que pactuada, \u201cinclusive com cl\u00e1usula de quita\u00e7\u00e3o ampla, geral e irrestrita do contrato de trabalho\u201d. A ministra explicou que, de acordo com o entendimento que vem se firmando no TST sobre a mat\u00e9ria, em processo de jurisdi\u00e7\u00e3o volunt\u00e1ria (em que as partes, de comum acordo, v\u00e3o \u00e0 Justi\u00e7a para formalizar um ato consensual), compete \u00e0 Justi\u00e7a do Trabalho homologar integralmente o acordo extrajudicial ou n\u00e3o homolog\u00e1-lo, sendo vedada a homologa\u00e7\u00e3o parcial.<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>De acordo com a relatora, o Judici\u00e1rio pode at\u00e9 afastar cl\u00e1usulas que considerar abusivas, fraudat\u00f3rias ou ilegais, \u201cmas n\u00e3o lhe cabe, sem a identifica\u00e7\u00e3o de v\u00edcios, restringir os efeitos do ato praticado, quando as partes pretendem a quita\u00e7\u00e3o total do contrato\u201d.&nbsp;&nbsp;<br><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br>A decis\u00e3o foi un\u00e2nime.<\/span><\/p>\n<p><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><br><b>Ementa do ac\u00f3rd\u00e3o:<br><\/b><\/span><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\"><i><br><\/i><\/span><\/p><p><i>&#8220;RECURSO DE REVISTA INTERPOSTO PELA EMPRESA REGIDO PELA LEI 13.467\/2017. ACORDO EXTRAJUDICIAL. ARTS. 855-B A 855-E DA CLT. QUITA\u00c7\u00c3O GERAL DO CONTRATO DE TRABALHO. HOMOLOGA\u00c7\u00c3O PARCIAL. 1. Caso em que o Tribunal Regional recha\u00e7ou a pretens\u00e3o do requerente de reconhecimento da quita\u00e7\u00e3o ampla, geral e irrestrita do&nbsp;<\/i><i style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\">contrato de trabalho, mantendo a senten\u00e7a que concluiu pela quita\u00e7\u00e3o do acordo apenas em rela\u00e7\u00e3o aos t\u00edtulos e valores expressamente consignados. 2. Todavia, a jurisprud\u00eancia desta Corte Superior vem se firmando no sentido de que, em processo de jurisdi\u00e7\u00e3o volunt\u00e1ria, compete \u00e0 Justi\u00e7a do Trabalho homologar integralmente ou n\u00e3o homologar o acordo extrajudicial, sendo vedada a homologa\u00e7\u00e3o parcial \u2013 ou com ressalvas &#8211; do mesmo. Com&nbsp;<\/i><i style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\">efeito, n\u00e3o havendo not\u00edcia de fraude, coa\u00e7\u00e3o, ou qualquer outro defeito apto a macular o neg\u00f3cio jur\u00eddico realizado entre as partes, deve ser reconhecida a quita\u00e7\u00e3o do acordo nos termos em que pactuada, inclusive com<\/i><\/p><p><i>cl\u00e1usula de quita\u00e7\u00e3o ampla, geral e irrestrita do contrato de trabalho, se houver, sob pena de ofensa \u00e0 legalidade e ao ato jur\u00eddico perfeito. 3.
