O colegiado negou o recurso da empregada contra decis\u00e3o que havia rejeitado seu pedido de reintegra\u00e7\u00e3o no emprego ou de pagamento de indeniza\u00e7\u00e3o correspondente.&nbsp;<\/p>\n<p><br><\/p>\n<p><b>Comum acordo<\/b><\/p>\n<p><br><\/p>\n<p>A rescis\u00e3o contratual por comum acordo foi criada na Reforma Trabalhista (Lei 13.467\/2017). Ela garante o pagamento de metade do aviso-pr\u00e9vio (se indenizado), indeniza\u00e7\u00e3o de 20% sobre o saldo do Fundo de Garantia do Tempo de Servi\u00e7o (FGTS) e acesso a at\u00e9 80% do valor dispon\u00edvel na conta do FGTS, al\u00e9m de outras parcelas.&nbsp;<\/p>\n<p><br><\/p>\n<p>Na reclama\u00e7\u00e3o trabalhista, a vendedora disse que seu contrato de trabalho fora rescindido nessa modalidade em outubro de 2019. Mas, em novembro, uma ultrassonografia revelou que ela j\u00e1 estava gr\u00e1vida quando saiu do emprego.&nbsp;<\/p>\n<p><br><\/p>\n<p>Por isso, pediu a reintegra\u00e7\u00e3o ou o pagamento de indeniza\u00e7\u00f5es correspondentes ao per\u00edodo da estabilidade provis\u00f3ria. Seu argumento foi o de que desconhecia a gravidez naquela ocasi\u00e3o, mas isso n\u00e3o significava que havia renunciado \u00e0 estabilidade. Tamb\u00e9m sustentou que a rescis\u00e3o ocorreu sem a assist\u00eancia do sindicato, o que a tornaria inv\u00e1lida, conforme previs\u00e3o do artigo. 500 da CLT.&nbsp;<\/p>\n<p><br><\/p>\n<p><b>Inten\u00e7\u00e3o de deixar o emprego<\/b><br><br><\/p>\n<p>Em primeiro grau, a Justi\u00e7a Trabalhista acolheu o pedido da vendedora e determinou o pagamento de indeniza\u00e7\u00e3o correspondente ao per\u00edodo da estabilidade. Mas, ao analisar recurso da empresa, o TRT considerou que a inten\u00e7\u00e3o dela de se desligar do emprego ficou evidente. A decis\u00e3o cita mensagens em que ela pede ao empregador para ser dispensada e diz que n\u00e3o podia \u201cpedir conta\u201d porque precisava do dinheiro. Tamb\u00e9m&nbsp; informou \u00e0 empresa que n\u00e3o cumpriria todo o aviso-pr\u00e9vio por ter encontrado outro trabalho.&nbsp;<\/p>\n<p><br><\/p>\n<p>Segundo o TRT, a rescis\u00e3o por comum acordo n\u00e3o pode ser revertida pela Justi\u00e7a se adotada corretamente, e nesse caso, n\u00e3o se aplica a necessidade de homologa\u00e7\u00e3o pelo sindicato.&nbsp;<\/p>\n<p><br><\/p>\n<p><b>Reciprocidade de interesses<\/b><\/p>\n<p><br><\/p>\n<p>A vendedora recorreu ao TST, mas a S\u00e9tima Turma manteve a decis\u00e3o. Conforme o relator, ministro Renato Lacerda de Paiva, nessa modalidade de rescis\u00e3o, a empregada recebe mais do que quando pede demiss\u00e3o e h\u00e1 reciprocidade de interesses entre empregado e empregador. Assim, ela n\u00e3o se assemelha ao pedido de demiss\u00e3o e n\u00e3o se requer assist\u00eancia sindical para que o desligamento tenha validade.<br><br><b>Ementa do ac\u00f3rd\u00e3o<\/b>:<br><br><\/p>\n<p>&#8220;<i>AGRAVO INTERNO. RECURSO DE REVISTA. AC\u00d3RD\u00c3O REGIONAL PUBLICADO NA VIG\u00caNCIA DA LEI N\u00ba 13.467\/17. ESTABILIDADE PROVIS\u00d3RIA \u2013 GESTANTE \u2013 RESCIS\u00c3O DO CONTRATO DE TRABALHO POR M\u00daTUO ACORDO \u2013 ART. 484-A DA CLT \u2013 AUS\u00caNCIA DE ASSIST\u00caNCIA SINDICAL NOS TERMOS DO ART. 500 DA CLT \u2013 N\u00c3O APLICA\u00c7\u00c3O. No caso, imp\u00f5e-se o provimento do agravo, a fim de que o recurso de revista seja regularmente processado, para melhor exame da mat\u00e9ria no recurso de revista. Agravo interno provido. RECURSO DE REVISTA. INTERPOSI\u00c7\u00c3O SOB A \u00c9GIDE DA LEI N\u00ba 13.467\/2017. SUMAR\u00cdSSIMO. ESTABILIDADE PROVIS\u00d3RIA \u2013 GESTANTE \u2013 RESCIS\u00c3O DO CONTRATO DE TRABALHO POR M\u00daTUO ACORDO \u2013 ART. 484-A DA CLT \u2013 AUS\u00caNCIA DE ASSIST\u00caNCIA SINDICAL NOS TERMOS DO ART. 500 DA CLT \u2013 N\u00c3O APLICA\u00c7\u00c3O. TRANSCEND\u00caNCIA JUR\u00cdDICA RECONHECIDA (alega\u00e7\u00e3o de viola\u00e7\u00e3o ao artigo 10, inciso II, al\u00ednea \u201cb\u201d, do ADCT da Constitui\u00e7\u00e3o Federal e de contrariedade \u00e0 S\u00famula n\u00ba 244, itens I, II e III, do TST). A mat\u00e9ria em exame se relaciona com a exist\u00eancia de quest\u00e3o nova em torno da interpreta\u00e7\u00e3o da lei trabalhista, raz\u00e3o pela qual se constata a presen\u00e7a da transcend\u00eancia jur\u00eddica da causa, a justificar o prosseguimento do exame do apelo. Ato cont\u00ednuo, cabe destacar que nas causas sujeitas ao procedimento sumar\u00edssimo (como o presente caso), a admissibilidade de recurso de revista est\u00e1 limitada \u00e0 demonstra\u00e7\u00e3o de contrariedade a s\u00famula de jurisprud\u00eancia uniforme do Tribunal Superior do Trabalho ou S\u00famula Vinculante do Supremo Tribunal Federal ou viola\u00e7\u00e3o direta da Constitui\u00e7\u00e3o Federal, conforme disp\u00f5e norma contida no art. 896, \u00a7 9\u00ba, da CLT. A controv\u00e9rsia em an\u00e1lise gira em torno da necessidade de homologa\u00e7\u00e3o sindical para a rescis\u00e3o do contrato de trabalho por comum acordo da empregada gestante com o empregador, nos termos do art. 484-A da CLT, acrescido pela Lei n\u00ba 13.467\/17. In casu, a reclamante aponta como violado os arts. 10, II, \u201cb\u201d, do ADCT e 6\u00ba e 7\u00ba, XVIII, da CF e contrariedade \u00e0 S\u00famula n\u00ba 244\/TST. Entretanto, os referidos dispositivos constitucionais, bem como a S\u00famula apontada, n\u00e3o possuem pertin\u00eancia com o caso em debate, qual seja, simetria entre o pedido de demiss\u00e3o e a rescis\u00e3o por acordo entre as partes, nos termos do art. 484-A da CLT, para os fins de aplica\u00e7\u00e3o do art. 500 da CLT. Cabe ressaltar inclusive que o art. 10 da ADCT trata t\u00e3o somente da hip\u00f3tese de dispensa por justa causa, hip\u00f3tese sequer debatida nos autos. Assim, eventual conhecimento do recurso de revista somente se daria por afronta a dispositivo infraconstitucional ou diverg\u00eancia&nbsp;<\/i><i style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\">jurisprudencial, o que n\u00e3o \u00e9 poss\u00edvel em procedimento sumar\u00edssimo. Ademais, note-se que, da an\u00e1lise da literalidade do art. 484-A da CLT, na rescis\u00e3o por comum acordo, h\u00e1, na verdade, transa\u00e7\u00e3o com reciprocidade de interesses. Note-se, inclusive, que o empregado recebe por metade o aviso pr\u00e9vio e a indeniza\u00e7\u00e3o sobre o saldo do FGTS, mas por inteiro as demais verbas decorrentes da rescis\u00e3o sem justa causa. Assim, a referida hip\u00f3tese de rescis\u00e3o contratual n\u00e3o se assemelha ao pedido de demiss\u00e3o, n\u00e3o se ajustando, pois, ao disposto no artigo 500 da CLT.
