Isso porque, nesses casos, \u00e9 necess\u00e1rio que seja apresentada prova concreta, o que n\u00e3o foi feito pelo empregado.<\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\"><br><\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\"><span style=\"color: var( --e-global-color-text ); letter-spacing: 0.3px;\">Para os magistrados, embora o trabalhador tenha afirmado ser v\u00edtima de fraude e de n\u00e3o ter inten\u00e7\u00e3o de deixar suas fun\u00e7\u00f5es, n\u00e3o apresentou prova da alegada ilicitude na ruptura do contrato.<\/span><br><\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\"><br><\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\">Al\u00e9m disso, informou, em depoimento pessoal, que saiu do trabalho porque &#8220;o sal\u00e1rio estava ruim e que sentiu que foi for\u00e7ado a deixar a empresa porque era mandado fazer tarefas que n\u00e3o deveria&#8221;. O pedido de demiss\u00e3o foi redigido e assinado pelo profissional.<\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\"><br><\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\">&#8220;<i>Saliente-se que a coa\u00e7\u00e3o \u00e9 um dos v\u00edcios de consentimento nos neg\u00f3cios jur\u00eddicos, caracterizando-se pelo constrangimento f\u00edsico ou moral para que algu\u00e9m, fundado em real temor de dano a sua pessoa, \u00e0 sua fam\u00edlia ou a seus bens, pratique algum ato contr\u00e1rio \u00e0 sua vontade. Sendo a coa\u00e7\u00e3o o extraordin\u00e1rio, n\u00e3o pode ser meramente alegada, devendo ser robustamente comprovada<\/i>&#8220;, ponderou a relatora, a ju\u00edza convocada Tha\u00eds Verrastro de Almeida.<\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\"><br><\/p>\n<p style=\"line-height: var(--wp--typography--line-height, var(--global--line-height-body));\">Os magistrados negaram a invers\u00e3o do \u00f4nus da prova, ou seja, a solicita\u00e7\u00e3o para que a prova da coa\u00e7\u00e3o fosse apresentada pelo empregador e n\u00e3o pelo empregado. Tamb\u00e9m foram rejeitados os pedidos de verbas rescis\u00f3rias, FGTS, seguro-desemprego e outros valores.
