Al\u00e9m disso, determinou a suspens\u00e3o de todos os processos em andamento no pa\u00eds que discutam a mesma quest\u00e3o jur\u00eddica at\u00e9 o julgamento definitivo do tema.<\/p>\n<p><br><\/p>\n<p>A controv\u00e9rsia gira em torno da seguinte pergunta: a simples previs\u00e3o de que as unidades possuem destina\u00e7\u00e3o residencial \u00e9 suficiente para impedir a loca\u00e7\u00e3o de im\u00f3veis por curta temporada atrav\u00e9s de plataformas digitais, ou seria necess\u00e1ria uma proibi\u00e7\u00e3o expressa na conven\u00e7\u00e3o condominial?<\/p>\n<p><br><\/p>\n<p>O tema surgiu a partir de um caso analisado pelo Tribunal de Justi\u00e7a de S\u00e3o Paulo, no qual um condom\u00ednio tentou impedir a utiliza\u00e7\u00e3o de um apartamento para loca\u00e7\u00f5es de curta dura\u00e7\u00e3o realizadas por meio da plataforma Airbnb. O Tribunal paulista entendeu que, na aus\u00eancia de veda\u00e7\u00e3o expressa na conven\u00e7\u00e3o do condom\u00ednio, a proibi\u00e7\u00e3o n\u00e3o poderia ser imposta apenas por delibera\u00e7\u00e3o assemblear, especialmente porque tal restri\u00e7\u00e3o afeta diretamente o exerc\u00edcio do direito de propriedade.<\/p>\n<p><br><\/p>\n<p>Ao admitir o recurso como representativo da controv\u00e9rsia, o STJ reconheceu a exist\u00eancia de grande quantidade de processos semelhantes em tramita\u00e7\u00e3o nos tribunais brasileiros e definiu que ir\u00e1 estabelecer uma tese com efeito vinculante para orientar o julgamento de casos futuros. A quest\u00e3o jur\u00eddica delimitada pela Corte \u00e9 a seguinte: \u201c<i>Definir se a cl\u00e1usula de destina\u00e7\u00e3o residencial prevista em conven\u00e7\u00e3o de condom\u00ednio \u00e9 suficiente para impedir a loca\u00e7\u00e3o de unidades aut\u00f4nomas por curto per\u00edodo, por meio de plataformas digitais, independentemente de proibi\u00e7\u00e3o expressa<\/i>.\u201d<\/p>\n<p><br><\/p>\n<p>A decis\u00e3o possui grande relev\u00e2ncia pr\u00e1tica porque atualmente existem entendimentos divergentes nos tribunais brasileiros. Em alguns casos, entende-se que a atividade desenvolvida por meio de plataformas digitais se aproxima de uma hospedagem, incompat\u00edvel com a finalidade estritamente residencial do condom\u00ednio. Em outros, prevalece o entendimento de que a loca\u00e7\u00e3o por temporada \u00e9 modalidade expressamente prevista na Lei do Inquilinato e que eventual restri\u00e7\u00e3o somente poderia ocorrer mediante previs\u00e3o clara na conven\u00e7\u00e3o condominial e observ\u00e2ncia dos qu\u00f3runs legais para sua altera\u00e7\u00e3o.<\/p>\n<p><br><\/p>\n<p>At\u00e9 que o STJ julgue o tema, os processos que discutem essa mesma quest\u00e3o permanecer\u00e3o suspensos em todo o territ\u00f3rio nacional. Ap\u00f3s a defini\u00e7\u00e3o da tese, os tribunais dever\u00e3o aplicar o entendimento firmado pela Corte Superior aos casos semelhantes.<\/p>\n<p><br><\/p>\n<p>A futura decis\u00e3o poder\u00e1 impactar diretamente propriet\u00e1rios de im\u00f3veis, investidores, administradoras de condom\u00ednios, s\u00edndicos e usu\u00e1rios de plataformas de hospedagem, trazendo maior seguran\u00e7a
